Due to my problems with Bulgarian Dreams I am contacted on a regular basis by people who find themselves in similar situations (long delays in completion, apparent breaches of contract, planning permission issues etc). I am often asked if there are any options to get out of the contract and get some or all of their money back. Whilst each situation is different there is usually a common theme and indifferent, if not outright rude and unprofessional attitude by the agents/developers involved.
I have now partnered with an English speaking lawyer, based in Sofia but willing to travel, who specialises in company and corporate law as well as all aspects of house purchases. He is already involved in several court cases involving off plan purchases going wrong, especially in connection with developments sold by Bulgarian Dreams, specifically The Orchard Complex in Bansko. These actions focus on the facts that buyers have paid over 60% of the purchase costs for apartments and many have not even been started due to a lack of planning permission. Others are very delayed. The buyers have no rights to use their apartments and a mortgage has been discovered over the development, meaning any financial difficulties and the bank would step in as the first creditor. There are breaches in contracts and some buyers are entitled to unilaterally rescind their contracts and claim their money back plus penalties. A number of cases are now either in court or being prepared for court. There are similar situations with developments along the coast.
While I am not qualified to give proper legal advice on such matters I can hear your story and maybe suggest a route forward or give general advice. I have also negotiated for those of you requiring more in depth and professional legal advice to receive an initial non-cost consultation to help you decide on a way forward.
